Supreme Court Declines to Consider Saving Stan "Tookie" Williams

The U.S. Supreme Court has now rejected Tookie's appeal to investigate the racism and discrimination at the heart of his case, as well as Tookie's innocence issues.
The U.S. Supreme Court has now rejected Tookie's appeal to investigate the racism and discrimination at the heart of his case, as well as Tookie's innocence issues. One issue highlighted the fact that the prosecutor in Tookie's original case removed all of the Black jurors from the jury, leaving an all-white jury to deliberate his case. During Stan's trial, this prosecutor made racially-coded remarks during his closing argument, comparing Stan during the trial to a Bengal tiger in the zoo and stating that a black community - South Central Los Angeles - was equivalent to the natural "habitat" of a Bengal Tiger. s

Now upheld by the United States Supreme Court, this ruling will establish as "case law" for the nation the right for prosecutors to exclude jurors on the basis of race and to denigrate minority defendants in front of all-white juries.

The ruling is a frontal attack on the civil rights of all Americans.

The California State Supreme Court had twice censured this prosecutor for equally discriminatory behavior. Indeed, a member of the California Supreme Court at that time made the following statement about that prosecutor:

...I believe that we must place the ultimate blame on its real source - the prosecutor. It was he who unconstitutionally struck Black prospective jurors. The record compels this conclusion and permits none other… This prosecutor knew that such conduct was altogether improper. The trial court told him as much. And so did we… This court attempted to teach this same prosecutor that invidious discrimination was unacceptable when we reversed a judgment of death because of similar improper conduct on his part. He failed - or refused - to learn his lesson. The result is another reversal - and another costly burden on the administration of justice.
Amicus Brief Filed By ACLU On Tookie's Behalf
The ACLU (American Civil Liberties Union), the national NAACP (National Association for the Advancement of Colored People) and several other civil rights groups have filed an amicus (Friend of the Court) brief urging the Ninth U.S. Circuit Court of Appeals to consider racist injustices in jury selection during Tookie's 1981 trial. October 11, 2005: The Supreme Court today ruled against Tookie, disregarding 9 of the 24 Ninth Circuit Court judges' assertion that the prosecuting District Attorney at Tookie's trial employed "reprehensible and unconstitutional" racist tactics, using animal-jungle metaphors to refer to Tookie and to the South Central environment in which he lived. This ruling means that minorities can now legally be summarily rejected from juries based on race. Tookie could be given an execution date as soon as January 2006.

According to Stan's own words in the true life story film on him, 'REDEMPTION', tookie himself confessed and dispelled that violence brings about Damage and hate, an irreparable loss of love,we then know that that the US supreme court acts contrary to this statement of truth.
For the initial juror to bring together singularly, an all white 'bench' of judges, then, racism, injustice, and biasim has been instilled. Therefore the court should take this very seriously and quickly reach a verdict of acquitance, for the sake of our children tomorrow and most importantly the black community.

Although I normally find the Canadian legal far too lenient, in the case of Stan "Tookie" Williams who has redeemed himself and been "rehabilitated" (with or without the help of the judcial system), I am proud to say that we do not have Capital Punishment in Canada. After all of these years and after all Williams has accomplished, what does killing him really accomplish??? Only that another family is destroyed and another mother loses her son. And to have had such an unfair trial filled with a jury of white folk makes this even harder for me to make sense of.

I really hate the fact that a country that hates murder will murder. There is no other way to look at it. If we jail people for killing and then we turn around and kill what are we teaching people in this place we call civilized. I hope that Arnold(someone who killed people for a living in movies) will grant him the option to have life without parole so that he can continue to make a difference in the life of so many influential children, even if it's from the inside.

To disregard the illegal actions of the prosecutors ("law abiding citizens?") in this case and justify their actions with evidence against Tookie that it clearly circumstantial is first, unconstitutional and overall, inhumane. It's ok for representatives of the law to break the law of mankind?!!. How hypocritical is that? We are all protected by the "law of man" or we are supposed to be. "Who are we to judge?" Society does judge, every day. That's what the justice system does. There is a right and a wrong. he was convicted of personally killing four people I beleive, not to mention starting a gang responsible for the deaths of thousands.

His actions in prison are commendable, but just becuase a death row inmate writes a book-writes poetry-gets religion-etc does not change anything. If you are against the death penalty fine, but don't use the excuse that you think he is innocent. The guy is guilty and I bet none of you calling for clemency has spent one minute thinking about his victims families.

It's been over 20 years that he has served his time, isn't that enough, do any of us know that what he was charged with that it actually did it? I knew him from my neighborhood and school, and no, I would not say he killed, and if he was the head of a gang does that mean he killed anyone? Think about it? I know, I know, having someone do it for you is just as bad.
I grew up around him and never did he disrespect me in anyway. And the person that I am nooe believes tha I knew him. But I did. The United States of America has no right to order for some one to be killed no matter the circumstances. What kind of justice system do we have if we call killing a man who killed others justice. No one on this earth has the right to kill or judge anyone, the only person who has this right is Jesus Christ. The sixth commandment of the ten commandments says "Thou shalt not kill." And that is exactly what the U.united S.states A.assasins are doing.

I have a simple question. This man is asking for clemency while I have to wonder....what have the last 26 years been?

Another question. Where's the clemency for the victims that he was convicted of killing and the thousands of victims affected by this man's choices (or lessons on how to NOT leave witnesses)?

Another question. If this man, who is supposed to be "Redeemed" (according to the movie that was supposed to be based on his life), where is he accepting responsibility for his actions? Letting Tookie out of jail would be one of the greatest travesties of justice ever commited in L.A. and that is saying a hell of a lot. There is no doubt that there is a certain element of him being a fallguy for the entire creation of the gang culture in South Central--a creation more of White Governance than any individual Black man. But he is THE founding father of the most destructive and deadly black street gang in U.S. history.

Now, if you are against the death penalty I can understand putting resources into a clemency fight--but I think anyone who gets motivation for this fight because this is a Black man, is an idiot and a racist. Putting Tookie to death, to me, would be no different than if you somehow managed to find a 170yr old founding member of the KKK and put him to death.

You can argue about the morals of killing someone--but I certainly wouldn't shed a tear for either, killed by the state or simply locked away.

I think the analogy is appropriate to anyone who brutally murders 4 people, regardless of their color, except that few, if any, wild animals kill without good reason. So the animals are the ones who should complain.

To those who say we can't execute murderers based on the Biblical "thou shalt not kill", you need to actually READ the Bible - it's not referring to punishment,as the same book gives, in the same Old Testament, many crimes for which execution is not only accepted, but is actually required.

Personally, if somone killed my whole family I still wouldn't wish the death penalty on them. Yea, I would be pissed and I would certainly wish for these people to be humiliated, but the death penalty is dehumanizing. It isn't justice, it's vengeance, and there is a difference. I cannot believe the hate that people have toward another person. After all, an eye for an eye leaves the whole world blind. People should watch a movie called 12 Angry Men before even starting a reflection on the death penalty. "If there is any form of doubt then the defendant cannnot be sentenced to death" is the main message..

The USA is one of the last rich countries to maintain death penalty even Japan is backing down. Could the reference to God in the constitution have anything to do with it?

Who's to say it was tookie? How about a court of law found him guilty. His appeals were denied. He has been given 29 extra years in which he did some good. However, 29yrs does not absolve you of guilt or of your due punishment. Besides, as THE representative of a notorius gang, he still has much to answer for. Nobel nomination, children books and awards do not mean shit to me, when you have killed 4 people and are responsible for whole lot more.

For those you who think he should be let out. You are out of your fucking mind.

I take a look routinely at many of the indymedia sites around the world. So far I have not come across such a high proportion of posters that seem to advocate the death penalty - I must say its a little disconcerting. The HRW routinely condemns the death penalty, as do many countries, from the west to the east.

How can a country which claims such a righteous attitude regarding the rest of the world be so un-developed regarding human-rights?

Perhaps it has something to do with this idea that 'god will sort them out' if you happen to be wrong ... in Europe we try to exclude our religious beliefs from the 'execution' of the law.

Hopefully the US will come into line with this reasoning some day soon.

My father was working in a 7/11 convenience store the night that Tookie decided to teach fellow gang members how NOT to leave witnesses. the first store they stopped at, he decided was not feasible for what he was needing, so he drove down the street to the store where my father was working. He was tied up, made to get down on his knees, and was then shot in the face. To top it off, Tookie made fun of the sounds my father made as he was dying, thus eliminating any possibility of a dignified death that Tookie will be receiving. Now tell me, how in the world was my father's death a situation that called for "kill or be killed stupid" as you so eloquently put it?

Im sorry but the sentence of death is not required . In my country the highly sentence is the perpetuity and everybody is happy .. Other than profanities, this person is so full of hate, and so eager to spew such hate, that he does not correctly spell such words as "the"..he spells "thw"; "men"....he spells "mem"; and "have"....he spells "hav". I avoid people like this at all times. A mind is a terrible thing to waste. And this "Ray" person - I cannot believe that he is of any benefit to any society. Tookie was the epitomy of violence, hatred, evil; but that was a long time ago. In 29 years one has many chances to reflect on what one has done. Yes, what Tookie has done in his past is disgusting. He murdered four people..ruined the lives of them and their families...and though that may be unforgivable, that does not give us the right to murder him. That is not what the prison system is for. There is no rehabilitation in a gas chamber or in a needle. What one has to look at is what Tookie is doing now. Yeah, he wrote a few books (as Ray so simply put it); think of the ramification those books have had. Think of how many people have been deterred from gang life...meaning think of how many lives have been ultimately saved due to Tookie's books. Nobody is letting the man out of prison, but no man has the right to kill Tookie, otherwise we would be no better than him. If for no other reason let Tookie live because of the good he is doing now and the good that he can continue to do.

There is alot going on in this comment. I read all of the other comments and decided to include my responses to them.

First of all, If we continued to obey the laws of man......
a) there would still be slavery, b) if Non-Whites could get on the bus--they would have to sit in the back, c) Non-Whites would still be told that they could only be porters, cooks, and maids-not doctors, lawyers, or teachers, d) Women and children would still be treated like property...The list can go on and on. But thank God there were people who saw past the laws of man and saw what was right.
Second, one thing that has to be realized is that people can change. There are plenty of people in prison/jail who are not "rehabilitated" and will never be a contributing member of society. However, Tookie did what so many sinners have done: realized the errors of their way and changed. He even made a MAJOR impact on the world. According to the Bible, The wages of sin is death. Sinners include liars, adulterers, fornicators, AND murderers, among countless others. But I would like to point out that God does not put a size on sin....man does. So, before we condemn a man to death for his wrong doings, we need to look at our own and see how we would like to be treated if we were in the same situation. If a lot of people were more sympathetic instead of apathetic the world would be a better place.
Third, it is more of a punishment to live with the fact that you have taken life than to put the murderer to death. I believe that Tookie took the guilt that he was feeling and used it as motivation to try and give back a little of what was taken.. although nothing ever replaces life.
Fourth, I would also like to point out that some people didn't come from the "nice side of town" where they deliver pizza after dusk, the taxi takes you to your front door, and you aren't lulled to sleep by the sound of gunfire. When these kids go outside to play, they see drug dealers, hookers, and the local crack heads. If all you see everyday is chaos, that is all you know unless someone else shows you different. So...my question to you is "What have you shown a young person today?"

I would also like to add that I have lost 2 family members to gun violence--the last one was buried 2 weeks ago. Not only does this thing affect the family who lost their loved one, but also the family of the person who committed the crime. Who is Stan Tookie Williams?

Stan was the co-founder in 1971 of the Los Angeles Crips gang. In 1981 he was convicted of murdering four people during two robberies and sentenced to death row at San Quentin State Prison. Stan deeply regrets his gang involvement but has always maintained his innocence of these crimes.

His trial was based on circumstantial evidence and the testimony of several witnesses, all of whom were facing a range of felony charges, including fraud, rape, murder and mutilation. Even the 9th Circuit Court of Appeals stated in a September 10, 2002, ruling that the witnesses in Stan’s case had “less-than-clean backgrounds and incentives to lie in order to obtain leniency from the state in either charging or sentencing.”

YES, IN NEARLY ALL MURDER CASES, PEOPLE WHO MURDER OTHER PEOPLE, GENERALLY ASSOCIATE WITH OTHER CRIMINALS. STANELY WILLIAMS DIDN'T HANG OUT WITH COLLEGE STUDENTS, HE WAS A DRUG ADDICTED, VIOLENT GANG MEMBER. DOESN'T IT MAKE SENSE THAT THE PEOPLE HE ASSOCIATED WITH ALSO HAVE CRIMINAL RECORDS?

There was physical evidence, but none of it pointed to Stan.

WELL, NOT EXACTLY. REMEMBER THE GUN USED IN THE MURDERS WAS PURCHASED BY STANLEY "TOOKIE" WILLIAMS. THAT PRETTY STRONG EVIDENCE.

• Fingerprints were found at both crime scenes, but they were not Stan’s. These fingerprints have never been identified.

BOTH OF THESE MURDERS WERE COMMITTED IN PUBLIC AREAS. A STORE AND A MOTEL, BOTH OF WHICH HAS DAILY CUSTOMERS USING THE BUSINESSES. MAYBE THE "REAL KILLER" WENT TO STANLEY HOME, STOLE HIS GUN, COMMITTED THE MURDERS, THEN DECIDED TO PUT THE GUN BACK INTO STANLEY'S HOME.

• A bloody boot print left near the victim at one of the crime scenes was not Stan’s. This boot print has never been identified.

ANYONE FAMILIAR WITH CRIME SCENES, KNOWS THAT IS COMMON TO HAVE SOMETIMES DOZENS OF PEOPLE WALK THROUGH THE CRIME SCENE BEFORE EVIDENCE IS PHOTOGRAPHED OR COLLECTED. (FIREFIGHTERS, EMS, POLICE OFFICERS, DETECTIVES). IT'S NOT LIKE CSI!

• A shotgun shell found at that crime scene was said to be from a gun purchased by Stan five years earlier. But the gun was, in fact, found under the bed of two people – a husband and wife facing felony insurance fraud charges and who were also under investigation for murdering their own crime partner. This husband-and-wife crime team did not serve any prison time and their murder investigation was dropped after they testified that Stan “volunteered” a confession to them.

WHY WASN'T THIS HUSBAND AND WIFE NOT CHARGED WITH ANOTHER MURDER??? BECAUSE THERE WAS NO EVIDENCE TO SUPPORT THE DEFENSE ATTORNEY'S CLAIM. AND NOT ONLY DID STANLEY GIVE THEM INFORMATION ABOUT THE MURDERS....HE TOLD THEM INFORMATION THAT HAD NOT BEEN RELEASED TO THE PUBLIC--INFORMATION THAT SOMEONE WOULD GET FROM ONLY BEING THERE AT THE CRIME SCENE.

• The “star” witness at Stan’s trial – a white man and longtime felon who was placed in a nearby cell while Stan awaited trial and was years later discovered to have been a paid police informant – also testified that Stan “volunteered” a confession to him. But nearly 20 years after Stan’s trial it was discovered that a Los Angeles police officer had left a copy of the police murder file involving Stan’s case in this informant’s cell for overnight study. The next day the murder file was picked up by that same officer, and the informant informed the police that Stan had volunteered a confession to him. In return for this testimony, the informant – who himself was facing the death penalty for rape, murder and mutilation – was given a lesser sentence that allowed him the possibility of parole and freedom.

THEY HAVE CHOOSEN TO DESCRIBE ONE OF THE WITNESSES AS A "STAR WITNESS." EVEN THOUGH THERE WERE SEVERAL WITNESSES THAT STANLEY ADMITTED COMMITTING THE CRIME TO. WHY DO THEY SAY "WHITE MAN" IN THEIR DESCRIPTION OF THIS WITNESS? WHAT DOES HIS RACE HAVE TO DO WITH HIS TESTIMONY? REMEMBER THEY WERE NUMEROUS WITNESSES WHO TESTIFIED AGAINST WILLIAMS. THEY ALSO FORGOT THAT THERE WERE OTHER INMATE WITNESSES WHO STANLEY WILLIAMS APPROACHED ABOUT MAKING AN ESCAPE ATTEMPT.

DID YOU KNOW THAT IN THE COURT DOCUMENTS STANLEY WILLIAMS WAS PLANNING TO ESCAPE PRISON AND TO HAVE ANOTHER WITNESS MURDERED? DID YOU KNOW HE PLANNED ON MURDERING CORRECTIONAL OFFICERS DURING THE PROCESS? DID YOU KNOW THAT A WOMEN WAS CAUGHT TRYING TO SMUGGLE STANLEY A TOOL TO AID IN AN ESCAPE? While on death row, Stan has written 9 highly-acclaimed children’s books that educate young people to avoid gangs, crime and incarceration. He has also worked to end gang violence through his peace protocol and Internet Project for Street Peace, an international peer mentoring program. "KICKED OFF" THREE AFRICAN-AMERICANS FROM SERVING AS JURORS? WELL, WHY WERE THEY "KICKED OFF"? ONE REPORTED THEY COULD NOT SERVE BECAUSE OF A WORK COMMITMENT AND ANOTHER DID NOT SUPPORT THE DEATH PENALTY. THE THIRD WAS REMOVED FROM THE JURY BECAUSE OF A SIMILAR SITUATION.

SO WHY DIDN'T WILLIAM'S DEFENSE TEAM BRING THIS UP DURING TRIAL OVER 20 YEARS AGO? OR EVEN 10 YEARS AGO? OR EVEN 5 YEARS AGO?

HIS DEFENSE TEAM HAS TRIED EVERYTHING THEY COULD AND NOW IT APPEARS THEY ARE PLAYING THE 'RACE CARD.'

This prosecutor made numerous racist remarks during the trial, comparing Stan to a “Bengal Tiger” in the San Diego Zoo whose natural jungle “habitat” was the equivalent of South Central Los Angeles.

STANLEY WILLIAMS WAS COMPARED TO A BEGAL TIGER AND THAT HIS HABITAT WAS CENTRAL LOS ANGELES. AFTER WE READ WHAT HE DID WE AGREE!

MAYBE IT'S JUST US, BUT WE DON'T HOW THIS IS A RACIAL REMARK?

STANLEY WILLIAMS HIMSELF SAID ABOUT HIS EARLY YEARS THAT HE COULD HAVE BEEN AN AGGRESSOR OR A VICTIM. HE CHOOSE TO BE THE AGGRESSOR.

HE KILLED A SINGLE-FATHER, A MOTHER AND FATHER AND A DAUGHTER FOR MONEY TO SUPPORT HIS DRUG HABIT. CALLING A PERSON WHO WOULD DO SOMETHING LIKE THIS A TIGER IS ACTUALLY PRETTY MILD!

The California State Supreme Court had twice censured this same prosecutor for equally discriminatory behavior. Indeed, a member of the California Supreme Court at that time made the following statement about that prosecutor:

...I believe that we must place the ultimate blame on its real source – the prosecutor. It was he who unconstitutionally struck Black prospective jurors. The record compels this conclusion and permits none other… This prosecutor knew that such conduct was altogether improper. The trial court told him as much. And so did we… This court attempted to teach this same prosecutor that invidious discrimination was unacceptable when we reversed a judgment of death because of similar improper conduct on his part. He failed - or refused - to learn his lesson. The result is another reversal - and another costly burden on the administration of justice.

WHY DO THEY TAKE CERTAIN COMMENTS OUT OF CONTEXT AND NOT LIST THE ENTIRE STATEMENT MADE BY THE CALIFORNIA SUPREME COURT. AND WHY IS IT, THAT STANLEY WILLIAMS IS STILL ON DEATH ROW? COULD IT BE BECAUSE AFTER THEY REVIEWED THE EVIDENCE AGAINST HIM THEY ALSO BELIEVE HIM TO BE GUILTY?

On October 11, 2005, the U.S. Supreme Court rejected Stan’s appeal to investigate the racism and discrimination at the heart of his case, as well as Stan’s innocence issues. This denial established as “case law” for the entire nation the right of prosecutors to exclude jurors on the basis of race and to denigrate minority defendants in front of white juries.

The ruling is a frontal attack on the civil rights of all Americans.

An execution date has been set for Stan Tookie Williams: December 13, 2005. In November 2005 his attorneys plan to file another Federal Habeas Petition that presents new evidence of innocence. At the same time a clemency team of lawyers has been formed to prepare a clemency petition for California Governor Arnold Schwarzenegger’s consideration. That clemency petition will be submitted to the Governor of California on November 7, 2005.

In the United States clemency is a request for a Governor (only a Governor can grant clemency) to not impose the death penalty, but instead to impose an alternative sentence: Life without the possibility of parole. That aside, the man has done more than most for mankind, while in prison. And, I believe a person can change....this is a changed man, and an asset to the world. His words promote love and friendship. Unlike Ray who says things to deliberately provoke, e.g. "if you had a clue or half a brain". And that my words made him "chuckle". My hope is that this is a child, and therefore still has room to grow. It is people with mindsets like Ray, not Tookie, that are a danger to this world, and a definite liablity to mankind. This is a man that created a group of friends not to murder others or cause chaos, but to survive in south central LA. Yes, it got out of hand and of course he made mistakes. I have not reviewed Tookie's case. I don't know what his past was like. Shoot..just from what I do know, his experiences with gang life sound like some people I know personally. And you know what...most of them people have changed. Some have admitted their crimes. (including taking a life) Time was served for some crimes and some crimes didn't result in time. But the point is.....THEY CHANGED. They have honest, hard-working jobs, they take care of their families, and some have received God into their hearts. I could better understand the desire for the death penalty if Tookie was in prison and maintained no regard for life. Shoot...he was sentenced to death. He could have killed others in prison and his plight would still be the same. But he took time on Earth to do positive things.
I haven't personally experienced projects and ghettos. I hope I don't offend anyone, but, I usually think of these areas as war zones. And to better understand the circumstances, I use my grandfather as an example. When my music-loving, patient grandfather returned from Vietnam, his mind was almost gone. All he knew was that someone was trying to kill him. His instinct was to do what was needed to survive. He had to be "deprogrammed" slowly but he never really got over the war. There are people in these areas (ghettos, projects, etc.) who, on a daily basis, are subjected to people with war-like tendencies (stealing, killing, looting, "local terrorists", etc.) In order to survive, they have to adopt some of those same tendencies. I'm not saying it is right. And people do have to take responsibility for their own actions. But, if in your world, it is "kill or be killed" all day-- everyday, how are you going to automatically change these actions/ideas if it has been okay in your world as long as you can remember? The instinct is to survive until someone "deprograms" those ideas/actions.
Yes....I know that Tookie started the crips and this has had devestating consequences in our communities, but did the gun companies know that their guns would be used for drive-bys? Did the drug companies know that their cold medicines would be used to make illegal, street drugs? Did the automobile companies know that their cars would be used for hit and runs? The idea may seem good at the time but then it gets into the hands of those that use if for bad....I'm sure Tookie started the crips as a group of friends who needed each other. No one is denying that the families have been devastated by the lost of their loved ones. My heart goes out to them.
It's just that..... to put anyone to death with such a flawed "justice" system makes no sense to me. There are people who have more incriminating evidence on them and get only 5, 10, 15 years in prison. There are cases when there are eye witnesses who point the person out in the courtroom and years later, the defendant is freed because of DNA evidence or someone admited they lied or it was proven that evidence was planted, etc.
Too many things went wrong in this trial. The prosecutors seemed to be so sneeky. Maybe if they were more focused on the truth instead of the conviction, there wouldn't be any doubt as to Stan's innocence or guilt. But, since the trial occurred as it did ....I have A LOT of reasonable doubt.....

Are people forgetting the goals of The U.S. Justice System or are people allowing emotion and rage take over their minds? Killing a man because you believe he murdered four people is not just, I think people need to really research the case and the U.S Justice System before making comments. This man's gun was used to kill those people but no evedence actuallt proved it was him who pulled the trigger. Haven't you ever done wrong in your life, but done something to show that you have changed, this man has made a complete change, better then the average person. He has served a very long sentnce for crimes he may and may not have done, I think it is time he be left alone. You know everyone can give there personal feelings toward this situation, but it all boils down to the fact that he was convicted of killing 4 innocent random people in cold blood. And he has the blood of thousands maybe evan more than that of others, some gang-related, some innocent by-standers. Now maybe if it was another state and he was convicted of this he would maybe have life. But since this happens to be in the state of California he was sentenced to death. THE LAW. While I commend what Tookie has done to repair much of the damage he caused, I am still dismayed that he's been trying to play both sides in order to spare his own life.

His entire case to the appealate system is that he was innocent, he's making the claim that he was wrongfully convicted. It's not based on him having paid for his crimes and that he's reformed. Despite his general apology, there has never been a special apology to those individuals who's life was destroyed by 4 murders that he commited. I've seen the claims of his innocence and what I see is a man unwilling to admit his culpability in a crime and apologize, because it may harm his chance at an appeal.

Yet, he also seeks clemency, which means he's accepting his guilt and asking for us to grant him mercy because he has reformed. In this case, I would be tempted to offer clemency, if he was willing to stop lying to try to save himself. Claiming an all white jury convicted him is false, there was one black man, a fillipino and a latino as well and they also voted for a conviction and for the death penalty. No appealate court felt there was compelling evidence that the district attorney's office had acted improperly in the handling of evidence or the procurement of witnesses. And despite this montain of evidence, he has never publicly confessed, but he wants mercy for those crimes.

If Tookie can't say I'm sorry, I did it, then I can't say you're forgiven.

I'm not sure how any HONEST person who has reviewed the facts in this case can come to the conclusion that they are SURE Tookie did it. Keyword here is HONEST. Quick review of the facts.

* The bloody bootprint.

The counter argument that this could have been a "EMT's" boot is just laughable! A) EMT's know enough about crime scenes not to overly disturb them. B) The police in the case could (and should) have simply checked this out. This is as easy as asking the EMTs who came to the scene to let you see their boots.

* The fingerprints. It's not simply that other fingerprints WERE found at the crime scene but also that Tookie's finger prints WERE NOT found.

* The couple with the murder weapon found under their bed.

Those who want to claim Tookie was guilty go with the argument that "Tookie told them information about the murder that wasn't already known". How about this? They knew information about the murder because THEY committed it? That's certainly possible. Yes, Tookie purchased the gun. But people often buy guns and then resell them on the streets. Is that wrong? Certainly. Is that a capital crime? Not under our (current) legal system.

And beyond that there is undisputed racist comments made by the prosecutor and the fact that all blacks were struck from the jury. Really, when I read that I thought "Is this California in 1980 or Missisippi in 1950?"

If you are HONEST you will have to admit that the evidence against Tookie is circumstantial and questionable. There were no eyewitnesses to the event, witnesses who SAID Tookie told them about the crime, but who should have been suspects themselves, and the prosecution was CLEARLY racially tainted. That leaves a catch 22. If, in fact, Tookie DIDN'T commit the crime then the only way he can please SOME of you is to LIE and say that he did.

Frankly I don't think clemency should be based on "forced" confession. Rather it should be based on what the person has to offer society now. Have any of you "Tookie haters" read Tookie's "Protocol for Peace"? Have you? Did you see the RESULTS of this? We're not talking about intangibles like how many parents say "Tookie's book saved my child." We're talking about the FACT that 150 members of the bloods and the crips in Newark New Jersey sat down and worked out a PEACE DEAL based on Tookie's protocol. If you read the protocol you'll see that it is A) common sense and B) totally workable and verifiable. How many lives may have been saved already by this?

Right now our country is embroiled in a discussion over whether or not it's ok to "torture" in order to save a life. Well is it ok to spare a life in order to save lives? We claim we must work with "unsavory charecters" in order to "fight the war on terrorism". Well what about a charecter with an "unsavory past" who has a proven track record on making our streets safer while he's still behind bars?

Read Tookie's protocol and it's results. Decide for yourself. Don't be blinded by hate. Up until YESTERDAY I was undecided about Mr. Williams. I thought "regardless of whether or not he's guilty of this crime. His life caused so much death". But now I see that his life can SAVE lives. Isn't saving lives more important than getting revenge?

According to the legal system Murder will get you life in prison without the posability of parole or the death sentance. Ok, I can understand life in prison without the posability of parole, but the death sentance is the same as murder. If it is aginst the law to kill someone and is punishable by the legal sytem taking a mans life, then is the legal system not also commiting murder? Regardless if Tookie Williams is inocent or not it is not our place to judge him for his crimes or accused crimes. Everyone has to answer to God on judgment day for their own wrong doings and no man or woman should be judged by their actions and be sent to death because in the Ten Comandments it states Thou Shall Not Kill. In all reality the one who takes the life of an imate on death row is also commiting murder and will have to answer to god on judgment day. So please tell me what is the difference from Tookie Williams suposedly taking the life of four people and the legal system taking the lives of many people? Further more, Tookie Williams is still claiming to be inocent of his accused crimes and he may very well be inocent, but yet he was convicted by an all white jury and racisim and biases played a big role in his conviction. Sorry folks - but as a cop (based in Canada), I know that the death penalty a)does not deter murder b)does not heal the victim's family.
Clemency, in this case, could actually do some good. The death penalty applied in this case injures your nations.

All I have to say that an eye for an eye, however in this case; if you do not have the actual proof then I do not think that one can make the decision to take a mans life. Someone said something very heavy to me last night, they said how do we know that this act from Brother Arnold, was not an iniciation "rite" using Brother Tookie as a sacrifice? And that made me think and pary for the man at the same time. After being incarcerated for all those years , no matter what Stanley served his time , this is a very sad reality of life.
